The Oz Park Baseball Association (“OPBA”) is a not-for-profit, parent- and family-run, private baseball and softball league. The OPBA’s mission is to provide high-quality youth baseball and softball instruction and competition.   

 

The undersigned, on behalf of himself or herself and on behalf of the participant(s) or player(s), understands that there is an inherent risk of injury associated with the sports of baseball and softball. The risks of injury, including bodily injury and even fatal injury, may be associated with actions or inactions of fellow players or participants and/or others. The risks of injury may also include economic damages in a variety of forms and/or risks not currently known or foreseeable.   

 

Therefore, the undersigned, on behalf of himself or herself and on behalf of the participant(s) or player(s), hereby specifically assumes all risks of injury, harm, loss, or damage, of whatever nature, in connection with any actions or events organized by, facilitated by, or associated with the OPBA, including but not limited to risks of injury, harm, loss, and/or damage caused or alleged to be caused in whole or in part by the negligence of the Releasees described below.  This assumption of risk includes any injury, harm, loss, or damages incurred in connection with OPBA actions or events, such as any games, practices, fundraisers, use of OPBA provided equipment, community events, field maintenance, or any similar actions or events.  

 

Further, the undersigned, on behalf of himself or herself and on behalf of the participant or player listed below (as well as any of their representatives, heirs, executors, and next of kin), hereby releases, waives, discharges, and covenants not to sue the OPBA, the Chicago Park District, and/or the OPBA’s coaches, directors, board of directors, officers, attorneys, commissioners, volunteers, sponsors, owners, managers, promoters, and/or lessees or lessors of premises used to conduct any OPBA games, practices, or events (collectively, “Releasees”) from, of, and for any and all liability, losses, damages, claims, causes of action, and demands caused or alleged to be caused in whole or in part by the negligence or other actions or omissions of any of the Releasees. 

 

If, despite this waiver and release, the participant or player (or any of his or her representatives, heirs, executors, or next of kin) makes a claim against any of the Releasees, the parent(s) and/or guardian(s) will indemnify Releasee(s) and reimburse the Releasee(s) for any money paid to the participant or player (or his or her representatives, heirs, executors, or next of kin).
